Terms of Service

These Terms of Service govern your access to and use of Notaday. Notaday is an AI-powered study workspace for uploading study materials, reading and annotating PDFs, creating notes, generating study tools, chatting with documents, and managing paid plans or Notaday Credits. By creating an account, buying a plan or credits, or using Notaday, you agree to these Terms.

Beta status

Notaday is currently in beta. Features, availability, performance, and generated results may change, be interrupted, or contain errors as we continue improving the service. Please report any problems or unexpected behaviour to support@notaday.app, and keep backup copies of any important study materials.

Who can use Notaday

You must be able to enter into a binding agreement in your location to use Notaday. Notaday is not intended for children under 13 or for anyone below the age required to use online services without parental consent in their location. If you use Notaday on behalf of an organization, you confirm that you have authority to accept these Terms for that organization.

Accounts and security

You are responsible for keeping your account credentials secure and for activity that happens through your account. You should use accurate account information, keep your email address accessible, and tell us at support@notaday.app if you believe your account has been compromised.

We may refuse, suspend, limit, or terminate access if we believe an account is being used in a way that violates these Terms, creates risk for Notaday or other users, attempts to avoid payment or limits, or may be unlawful.

Your content

You keep ownership of the study materials, PDFs, notes, drawings, highlights, comments, pasted images, Free Spaces, Notaday Docs, and other content you upload or create in Notaday. You give Notaday permission to host, store, copy, process, display, transmit, and modify your content only as needed to provide, secure, maintain, and improve the service and the features you choose to use.

You are responsible for making sure you have the rights needed to upload, store, process, and use your content in Notaday. Do not upload copyrighted, confidential, personal, or restricted materials unless you have permission and are comfortable with those materials being processed by Notaday and its service providers as described in our Privacy Policy.

Generated study content

Subject to these Terms, you may use the notes, summaries, quizzes, flashcards, exercises, Ask AI messages, and other study outputs generated for your account. Notaday does not claim ownership of your prompts, uploaded study materials, or generated study content, but the same output or similar output may be generated for other users because AI systems can produce similar results from similar requests.

AI features and generated output

Notaday includes AI features such as knowledge extraction, Ask AI, summaries, smart notes, quizzes, exercises, flashcards, and exercise answer checks. AI features may send relevant content, messages, extracted text, uploaded PDFs, or recent chat context to AI providers so they can generate the requested output.

AI output can be incorrect, incomplete, outdated, or unsuitable for your situation. Notaday is a study aid, not a replacement for teachers, professional advice, independent research, or your own judgment. You are responsible for reviewing generated content before relying on it, submitting it, sharing it, or using it for exams, assignments, decisions, or other work.

You are solely responsible for your use of AI features and generated output, including any decision, submission, publication, communication, or action you take based on it. To the fullest extent permitted by law, Notaday is not responsible for errors, omissions, inaccuracies, academic consequences, losses, damages, or other outcomes arising from your use of or reliance on AI-generated content.

You may not use Notaday to generate or distribute content that is unlawful, harmful, abusive, deceptive, infringing, sexually exploitative, or intended to cheat, impersonate, harass, spam, or bypass academic, security, or platform rules.

Plans, subscriptions, and billing

Notaday offers a Free plan and an A+ Student subscription. The Free plan includes limited uploads, documents, spaces, notes, storage, and monthly credits. A+ Student includes higher or unlimited product limits, 15 GB total storage, and 300 monthly credits while the subscription is active.

Paid subscriptions, credit topups, invoices, payment details, and cancellations are processed through Polar. Prices, plan features, credit allowances, and storage limits may change in the future. If a paid change affects an active subscription, we will try to provide reasonable notice before the change applies, unless the change is required for legal, tax, security, provider, or operational reasons.

Checkout may show taxes, currency conversion, or payment fees required by law or by payment providers before you complete payment. You are responsible for any taxes, charges, or fees that apply to your purchase unless checkout states otherwise.

A+ Student renews automatically unless canceled before the next billing period. You can cancel through the Polar customer portal. Cancellation stops future renewal charges, and A+ access remains active until the end of the paid billing period. Refunds are handled under our Refund Policy and any non-waivable rights required by applicable law.

Notaday Credits

Notaday Credits are digital credits used for AI generation. Each AI action may consume a different credit amount, and the app may show the cost before generation. Current examples include Ask AI messages, knowledge extraction, summaries, smart notes, quiz questions, exercise questions, flashcards, and exercise answer checks.

We may change the number of Notaday Credits required for any AI action and the price of credit topups at any time. The credit cost displayed in the app when you confirm a generation applies to that generation. Changes apply prospectively and do not change credits already added to your account, except where required by law.

Monthly subscription credits reset each billing month and do not roll over. Purchased topup credits do not expire under the current policy and are used after monthly credits. Credits have no cash value, are not a bank account or stored-value account, cannot be transferred outside Notaday, and cannot be exchanged for cash except where required by law or stated in our Refund Policy.

If a generation fails because of a Notaday system error after credits were deducted, Notaday may restore the deducted credits to your account. We may decline credit restoration for failed requests caused by unsupported files, user input, account abuse, provider restrictions, or violations of these Terms.

Storage, limits, and cleanup

Free accounts include 100 MB of total storage. A+ Student accounts include 15 GB of total storage while the subscription remains active. Free accounts also have limits such as 10 uploaded PDFs total, 30 MB maximum upload size per PDF, 5 Notaday Docs, 5 Free Spaces, 20 short notes, and 12 monthly credits.

If your storage usage exceeds the Free plan limit after your subscription ends or your account otherwise has no active subscription, your account may enter read-only mode. You may continue to access and delete content, but uploads, new saves, and AI generation may be paused until you reduce storage usage below the Free limit or activate a subscription.

If your account remains over the Free storage limit for 180 days without an active subscription, we may permanently remove your oldest uploaded files and their associated assets, including thumbnails, annotations, generated study tools, knowledge extractions, and file-linked chats, until your usage is within the Free storage limit. We may send warnings on Day 150, Day 173, and Day 179 before cleanup on Day 180.

Accounts without an active subscription that remain inactive for 300 days may have all stored study content removed to manage storage resources, including uploads, short notes, Notaday Docs, Free Spaces, generated study content, knowledge extractions, and file-linked chats. We may send inactive-account warnings on Day 270, Day 293, and Day 299 before cleanup on Day 300. Active A+ subscriptions are exempt from inactive cleanup while the subscription remains active.

You are responsible for maintaining your own backup copies of important study materials. Notaday is not intended to be your only backup or archive.

Acceptable use

You may not misuse Notaday or help anyone else misuse it. This includes attempting to access accounts, data, systems, or storage that you do not own, probing or bypassing security controls, scraping the service, overloading infrastructure, reverse engineering non-public parts of the service, interfering with rate limits, creating abusive automation, or using Notaday to host malware, spam, phishing, scams, or unlawful content.

You may not use Notaday to infringe intellectual property rights, violate privacy rights, upload content you do not have permission to use, impersonate another person, misrepresent generated content as verified fact, or use AI features to cheat in a way that violates your school, university, employer, or exam rules.

Copyright and takedown requests

If you believe content in Notaday infringes your copyright or other rights, contact support@notaday.app with enough detail for us to identify the content, understand the claimed right, and reach you. We may remove or restrict content and may suspend repeat infringers or accounts that repeatedly upload content without permission.

Notaday intellectual property

Notaday and its software, design, branding, interface, workflows, and service content are owned by Notaday or its licensors. These Terms do not give you ownership of Notaday intellectual property. You may use Notaday only as allowed by these Terms and the app features available to your account.

Third-party services

Notaday relies on third-party providers, including Supabase, Cloudflare, Polar, Resend, Google, OpenAI, DeepSeek, and Freepik. Your use of features connected to those providers may also be affected by their terms, policies, availability, rate limits, and technical restrictions. Notaday is not responsible for third-party services that we do not control.

Service changes and availability

We may add, change, suspend, or remove features, limits, providers, models, pricing, or parts of the service. We try to keep Notaday available and useful, but we do not guarantee uninterrupted access, error-free operation, permanent availability of every feature, or compatibility with every file, browser, device, or school workflow.

Account deletion

You can request account deletion from the app. Account deletion removes your account and requests deletion of associated stored files and app storage. Some records may remain for a limited time where required for billing, security, legal compliance, backups, dispute resolution, or fraud prevention.

Ending access

You may stop using Notaday at any time. If your account is closed, suspended, deleted, or terminated, your right to access the service ends, but sections that by nature should continue will continue, including payment obligations, content permissions needed for prior service operation, acceptable use, intellectual property, disclaimers, limitation of liability, and any terms needed to resolve disputes or enforce these Terms.

Privacy

Our Privacy Policy explains how Notaday collects, uses, stores, and shares information. By using Notaday, you also agree that your information and content may be handled as described in the Privacy Policy.

Disclaimers

Notaday is provided on an as-is and as-available basis. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability. Nothing in these Terms limits rights that cannot be waived under applicable law.

Limitation of liability

To the fullest extent allowed by law, Notaday will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost content, business interruption, academic consequences, or reliance on AI output. Our total liability for any claim relating to Notaday will be limited to the amount you paid to Notaday in the 3 months before the claim, or 50 USD if you did not pay Notaday during that period.

Changes to these Terms

We may add to, change, suspend, or remove any part of these Terms at any time. If we make material changes, we will update the date above and may provide additional notice in the app or by email. Continued use of Notaday after updated Terms take effect means you accept the updated Terms.
